Ruckerworks Foundry – Full Terms of Service
These Terms of Service (“Terms”) form a legally binding agreement between you (“User,” “you,” or “your”) and Ruckerworks Foundry (“Company,” “we,” “us,” or “our”). These Terms apply to all individuals who access or use the Ruckerworks Foundry platform as either a Creator or a Subscriber. By creating an account or using our services, you agree to comply with these Terms. If you do not agree, do not create an account or use the platform.
- Eligibility
1.1 You must be at least 18 years old and legally capable of entering into a binding contract under applicable law.
1.2 You represent and warrant that all information you provide is accurate, complete, and current.
- Account Types
2.1 Creator Accounts Creators may publish original written works, serialized content, or other permitted materials (“Content”). Creators retain all ownership rights to their Content. By publishing, you grant Ruckerworks Foundry a non-exclusive, worldwide, royalty-free license to host, display, and distribute your Content to subscribers. You have full control over your Creator Profile, including subscription rates and publication schedule, subject to compliance with these Terms.
2.2 Subscriber Accounts
Subscribers create free accounts to access and purchase subscriptions to creators’ content.
Subscription pricing is determined by the creator and stated in U.S. Dollars.
Subscriptions automatically renew on the billing cycle selected at purchase unless canceled.- Monetization and Payments
For Creators:
3.1 Commission: Creators earn ninety percent (90%) of subscription revenue collected from their subscribers.
3.2 Payouts: Payments are made monthly via Stripe, less applicable taxes, fees, and adjustments.
3.3 Taxes: Creators are solely responsible for reporting and paying any taxes associated with earnings.
For Subscribers:
3.4 Billing: All subscription payments are securely processed via Stripe.
3.5 Unsubscribing: You may cancel subscriptions at any time. Access continues until the end of the current billing period.
3.6 Refunds: Refunds are handled in accordance with Ruckerworks Foundry’s Refund Policy.
- Acceptable Use Policy
4.1 Prohibited Behavior
You may not post, share, promote, or engage in any content or conduct that discriminates against, disparages, or promotes hostility toward any individual or group.
4.2 Hate Speech and Harassment
Hate Speech: You may not post or promote content that advocates for, glorifies, or encourages violence, hatred, or discrimination.
Harassment: You may not engage in targeted harassment, threats, intimidation, or any conduct intended to cause distress, fear, or harm to another User.4.3 Illegal Activity
You may not use the platform for any unlawful purpose or in violation of any U.S. federal, state, or local laws, including Oregon law. This includes:
Soliciting, promoting, or facilitating criminal activity;
Distributing illegal materials;
Engaging in fraudulent or deceptive practices.- Enforcement
Violations of these Terms or the Acceptable Use Policy may result in:
Immediate suspension or termination of your account;
Removal of offending content;
Loss of access to any content or subscription benefits without refund;
Referral to law enforcement if actions are believed to violate U.S. or Oregon law.- Data Privacy
6.1 We collect and process personal data in accordance with our Privacy Policy.
6.2 Creators and subscribers must comply with all applicable data protection laws when handling personal information.
- Disclaimers and Limitation of Liability
7.1 The platform is provided “as is” without warranties of any kind.
7.2 To the fullest extent permitted by Oregon law, we are not liable for any indirect, incidental, or consequential damages arising from use of the platform.
- Indemnification
You agree to indemnify, defend, and hold harmless Ruckerworks Foundry and its affiliates from any claims, damages, liabilities, or expenses arising from your use of the platform, your Content, or your violation of these Terms.
- Governing Law and Dispute Resolution
9.1 These Terms are governed by the laws of the State of Oregon without regard to conflict-of-law principles.
9.2 Any disputes shall be resolved in the state or federal courts located in Oregon, and you consent to the jurisdiction of such courts.
- Amendments
We may update these Terms at any time. Updates will be posted on our website with the “Effective Date” revised. Continued use of the platform constitutes acceptance of the updated Terms.
- Acknowledgment
By clicking “I Agree,” when creating an account, or using Ruckerworks Foundry, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
